Kuwait Airways Corporation (KAC), Kuwait's national airline, has decided to stop all of their inter-European flights instead of accepting Israeli passengers.

In mid-April, Lawfare Project filed an administrative complaint against the airlines with the Swiss Federal Office of Civil Aviation as well as a criminal complaint with the Prosecutor General against Kuwait Airways Corporation on behalf of an Israeli national living in Switzerland who was denied a ticket on the Kuwait Airways flight from Geneva to Frankfurt, Germany.

Lawfare Project claimed the policy violated “the Swiss Penal Code as well as the Swiss constitution, which protects individuals from discrimination based on race, religion and ethnicity.”

"By cancelling these flight paths rather than admitting Israelis on KAC flights," the Lawfare Project said, "the airline, wholly owned by the Kuwaiti government, is demonstrating its commitment to discrimination, even while exposing itself to enormous pecuniary loss."

Earlier this year, Kuwait Airways canceled its route between New York City and London rather than serve Israeli travelers. That decision came after the U.S. Department of Transportation found that the airline’s refusal to allow Israeli citizens to fly on the route amounted to “unreasonable discrimination” because Israeli passport holders have the legal right to travel between the United States and the United Kingdom.

The Lawfare Project is a nonprofit legal think tank based in New York City that mobilizes public officials, media, jurists and legal experts to counter the international lawfare phenomenon: the abuse of the law as a weapon of war against Western democracy.
